Our Fair Dealing Policy
All images, quotes, film clips and excerpts are presented within this website under the “fair dealing” provisions of the Australian Copyright Act 1968. Within this provision, a researcher can copy a reasonable portion of literary, dramatic, musical or artistic work and audio-visual material without the permission of the copyright owner, provided the copying is for the purpose of research or study, criticism or review.
Material may therefore reproduced within the Paul Arthur website where required in the context of a blog posting under both Sect 41 of the Copyright Act 1968:
- “A fair dealing with a literary, dramatic, musical or artistic work, or with an adaptation of a literary, dramatic or musical work, does not constitute an infringement of the copyright in the work if it is for the purpose of criticism or review, whether of that work or of another work, and a sufficient acknowledgement of the work is made.”
And Sect 42 of the Copyright Act 1968:
- “A fair dealing with a literary, dramatic, musical or artistic work, or with an adaptation of a literary, dramatic or musical work, does not constitute an infringement of the copyright in the work if: (a) it is for the purpose of, or is associated with, the reporting of news in a newspaper, magazine or similar periodical and a sufficient acknowledgement of the work is made; or (b) it is for the purpose of, or is associated with, the reporting of news by means of a communication or in a cinematograph film.”
Accordingly, Paul Arthur WILL NOT USE ITS SERVICES TO TRANSMIT, ROUTE, PROVIDE CONNECTIONS TO OR STORE ANY MATERIAL THAT INFRINGES COPYRIGHTED WORKS OR OTHERWISE VIOLATES OR PROMOTES THE VIOLATION OF THE INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY.
